1. Agreement to Terms

By accessing and using the services provided by Tamdoma d.o.o. za informatičke usluge ("Company", "we", "our", or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, then you may not access our services.

2. Our Services

Tamdoma provides AI-powered marketing automation services, including but not limited to:

• Content generation and automation
• Lead qualification systems
• Campaign optimization
• Customer support AI solutions
• Analytics and insights
• Workflow automation

All services are provided with human supervision and expertise to ensure quality and effectiveness.

3. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services:

• In any way that violates any applicable law or regulation
• To transmit any unauthorized advertising or promotional material
• To impersonate or attempt to impersonate the Company or another user
• In any way that infringes upon the rights of others
• To engage in any conduct that restricts or inhibits anyone's use of our services

4. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Tamdoma d.o.o. za informatičke usluge and its licensors. The Service is protected by copyright, trademark, and other laws of both Croatia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Any content generated through our AI services for your use becomes your property, subject to any applicable third-party rights. However, we retain the right to use anonymized and aggregated data to improve our services.

5. Payment Terms and E-commerce Compliance

Payment terms are as agreed in your service agreement. All fees are inclusive of applicable VAT as required by Croatian and EU law. Payment is due within 30 days of invoice date unless otherwise agreed in writing. Late payments may incur interest at the statutory rate.

Online Payments: We use secure third-party payment processors (such as Mollie) that comply with EU payment services regulations (PSD2) and maintain PCI DSS compliance for card transactions.

Refunds: Refund policies are governed by your specific service agreement and applicable EU consumer protection laws. For digital services that have been fully delivered with your consent, the standard 14-day withdrawal period may not apply.

Dispute Resolution: Any payment disputes can be resolved through your payment provider's dispute process or through EU-approved alternative dispute resolution mechanisms.

6. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information received from the other party during the provision of services. This obligation survives the termination of these Terms.

7. Data Protection and Privacy

We process personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) and Croatian data protection laws.

Data We Collect: Any data we collect is solely for the purpose of facilitating communication between Tamdoma d.o.o. za informatičke usluge and potential clients. We do not sell, broker, or share your data with third parties for commercial purposes.

Data Usage: Personal information provided through contact forms, emails, or other communication channels is used exclusively to:

• Respond to inquiries and service requests
• Provide quotes and service proposals
• Deliver contracted services
• Maintain communication regarding ongoing projects

Data Security: We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction.

8. Limitation of Liability

To the maximum extent permitted by Croatian and EU law, Tamdoma d.o.o. za informatičke usluge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claims under these Terms shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Tamdoma d.o.o. za informatičke usluge, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of our services or violation of these Terms.

10. Service Modifications

We reserve the right to modify or discontinue, temporarily or permanently, our services (or any part thereof) with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of our services.

11. Termination

Either party may terminate the service agreement with 30 days written notice. We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

12. Governing Law and EU Consumer Rights

These Terms shall be governed and construed in accordance with the laws of the Republic of Croatia and applicable EU legislation, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the jurisdiction of Croatian courts.

EU Consumer Rights: If you are a consumer located in the European Union, you benefit from mandatory consumer protection provisions under EU law. Nothing in these Terms affects your statutory rights as a consumer.

Right of Withdrawal: In accordance with EU consumer law, consumers have the right to withdraw from service contracts within 14 days of contract conclusion, unless the service has been fully performed with your explicit consent.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
